Terms and Conditions.
1. Definitions
1.1 “The Performer” means Mr David Richards
1.2 “The Booking” means the reservation by the Client for the date on which the Performer’s Services are required.
1.4 “The Client” means the person, organisation or company by whom the Booking is made.
1.5 “The Contract” means the agreement between the Performer and the Client for the provision of the Performer’s services as set out in writing between the two, and incorporating these Terms and Conditions.
1.6 “The Date” means the day and time on which the Performer’s Services are required.
1.7 “The Services” means the performance of the Performer’s magic act.
2. Bookings
2.1 The performer will ask the Client to confirm details of the booking by email. The Performer will outline the Services to be provided on the Date by email. This shall constitute the Contract.
2.2 The Booking shall remain provisional until the clearance of any deposit (or discounted fees) requested. If this is not carried out within 14 days of their issue – or at the timeframe requested by the Performer – the Booking shall lapse.
3. Payment
3.1 The Performer reserves the right to require full payment - or alternatively a deposit of between 10% and 50% - to be paid to secure the Booking.
3.2 All payments shall be made in pounds sterling (£).
4. Failure to Perform
If the Performer cannot perform the Services due to fire or other casualty, strike, act of God, or other cause beyond his control including, for the avoidance of doubt, due to the Performer’s illness, then the Performer shall return any sums received to the client, but shall have no further liability to the Client with respect to the Contract.
5. Cancellation by the Client
In the unfortunate event that the Client has to cancel the Booking the Client must notify the Performer in writing and shall forfeit any deposit – or discounted fees - already paid.
6. General
6.1 The Contract incorporates the entire understanding of the parties. Any modifications of the Contract must be agreed in writing by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver or subsequent breach or default of either the same provision or any other provision of the Contract.
6.2 These Terms and Conditions apply to the Contract to the exclusion of any other terms and conditions.
6.3 The Contract shall be governed by the Laws of England and Wales any dispute shall be subject to the exclusive jurisdiction of the English Courts.
